Arkansas-Oklahoma Railroad, Inc. Flagging Tariff AOK-100

THE FOLLOWING RULES AND CHARGES ARE APPLICABLE IN REGARD TO FLAGGING ON THE ARKANSAS-OKLAHOMA RAILROAD, INC. (AOK):

Any time a contractor or other third party is performing work that involves personnel or equipment on, under, or over the Railroad’s tracks, facilities, right of way, or any other property, such activity may impact rail transportation, therefore, at least one Railroad representative (“Flagger”) must be present. Based upon the scope and location of the work, the Railroad’s Vice President of Safety and Compliance will determine if additional Flaggers are required.

Rates for flagging services are as follows:

$1,350.00 per 8 HOUR DAY.

If a Flagger(s) is called for duty, but not needed, a Call Charge of $550.00 per Flagger will apply.

Flagman’s drive time to and from worksite are included. 

Should a Flagger(s) be required to move from one location to another during the day, an additional charge of $275.00 will be assessed for vehicle and/or equipment use.

Associated Costs including lodging

Flagging shall be billed every calendar week, and shall be payable upon receipt. Overdue bills shall be assessed interest at the then-current statutory judgment interest rate. Payments for Flagging are to be collected by and accrue solely to the AOK.  It is the sole responsibility of the Contractor applying for Right of Entry to pay all applicable invoices for flagging.  Any outside party assuming responsibility for payment of flagging services must be pre-approved, in writing, by Railroad. 

All contractors or other third parties using flagging services shall abide by any instructions given by the Flagger concerning railroad safety and/or security. Flaggers have the right, but not the duty, to evict from the right of way, any person or persons who are in possession of, or under the influence of, alcohol, any intoxicating drug (whether legal or not), any weapon, firearm, explosive, flammable, or other dangerous article(except for fuel in authorized vehicle or equipment tanks), or is conducting themselves in a manner which the Flagger, in his sole discretion, deems to be unsafe, or an unreasonable threat to railroad safety and security.

SET YARDS FEES- If the contractor requests to use areas within railroad right of way but outside the designated work zone for purposes of staging or storing of equipment, materials, or other job associated items, an additional fee of $350 per day will apply.  Request for access to establish a set yard will be submitted in writing to the Railroad. 

WORKING WITHIN RAILROAD RIGHT OF WAY, INCLUDING STAGING OF EQUIPMENT, CREWS/WORKERS TRAVERSING OVER THE RIGHT OF WAY IN A FASHION THAT CREATES A CONSTRUCTION WORKZONE, OR ANY OTHER COORDINATED ACTIONS THAT WOULD COMPRAMISE RAILROAD SAFETY, WITHOUT A FLAGMAN ON SITE AND/OR NOTICE TO RAILROAD, WILL RESULT IN A FINE OF $2,500.00. NO FURTHER FLAGGING SERVICES OR WORK WITHIN THE RAILROAD RIGHT OF WAY WILL BE SCHEDULED UNTIL SAID FINE IS PAID IN FULL. A SECOND VIOLATION WILL RESULT IN THE CONTRACTOR BEING PROHIBITED FROM WORKING ON OR WITHIN RAILROAD PROPERTY.

NOTE: This tariff does not give any person(s) the right of entry. Right of entry must be applied for and obtained in writing PRIOR to entry on AOK property. Person(s) requiring right of entry will additionally provide insurance coverage per AOK specifications. For right of entry and AOK insurance requirements, please contact:
